Terms of Service

The binding legal agreement between you and KidsPref LLC governing access to and use of Detect The Bet by parents, monitored minors, and monitored young adults.
Please read carefully. These Terms contain a binding arbitration clause and a class action waiver in Section 17 that affect your legal rights.
1. Acceptance of terms
These Terms of Service (“Terms”) constitute a binding legal agreement between you and KidsPref LLC, a New York limited liability company operating under the trade name “Detect The Bet” (“KidsPref,” “we,” “us,” or “our”), governing access to and use of the Detect The Bet mobile application and the detecthebet.com website (collectively, the “Service”).
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not create an account, access, or use the Service.
2. Users and roles
The Service involves three types of users:
A Account-holder parents
The account-holder parent is the primary contracting party with KidsPref. To create an account, you must:
- Be at least 18 years of age;
- Be the parent or legal guardian of any minor or young adult whose financial activity you intend to monitor through the Service, or otherwise have full legal authority to monitor that individual’s financial activity under applicable law;
- Have the legal capacity to enter into a binding contract under the laws of your jurisdiction;
- Not be a person prohibited from using the Service under applicable U.S. law or the laws of your jurisdiction;
- Agree to comply with these Terms and all applicable laws.
By creating an account, you represent and warrant that you meet each of the above requirements.
B Monitored minors aged 13–17
Minors aged 13–17 may be added to an account by their parent or legal guardian. Minors aged 13–17 may sign in to the Service to view their own financial activity, view signals, and use educational features.
Because minors under the age of 18 generally cannot form a binding contract under New York law, monitored minors aged 13–17 do not enter into these Terms as a contracting party. The account-holder parent agrees to these Terms on the minor’s behalf and is solely responsible for compliance with these Terms with respect to the minor. The minor will be presented with an age-appropriate notice describing what the Service does with their information at first sign-in.
C Monitored young adults aged 18–22
Young adults aged 18–22 may be added to an account by a parent or legal guardian. At first sign-in, the young adult will be required to consent to being monitored by the named parent through a consent screen. The young adult may not access the Service until consent is given. If the young adult declines consent or later withdraws consent (Section 2.4), they will be removed from the account.
By consenting to monitoring, the young adult also agrees to these Terms as they apply to the young adult’s own use of the Service. The account-holder parent remains a contracting party with KidsPref for the parent’s own use of the Service and for the parent’s continued authorization to maintain the family account.
2.4 · Withdrawal of consent by young adults aged 18–22
A monitored young adult aged 18–22 may withdraw consent to monitoring at any time by contacting alex@detecthebet.com or by using in-app controls when available. Withdrawal of consent results in the young adult’s removal from the account and revocation of their bank connection. The account-holder parent will be notified of the removal.
2.5 · Prohibition on use by anyone under 13
The Service is not available to anyone under 13 years of age. Account-holder parents may not add anyone under 13 to the Service. If we become aware that anyone under 13 has accessed the Service, we will remove that individual immediately and delete their information.
2.6 · Account security
Each user (account-holder parent, minor 13–17 with sign-in access, or young adult 18–22) is responsible for safeguarding their own account credentials. Account-holder parents are additionally responsible for compliance with these Terms with respect to monitored minors aged 13–17. Notify us immediately at alex@detecthebet.com of any unauthorized use of an account or any other security breach.
2.7 · Authority to consent on behalf of minors
By adding a minor aged 13–17 to your account, you represent and warrant that:
- You are the parent or legal guardian of the minor, or you otherwise have full legal authority under applicable law to monitor the minor’s financial activity;
- You have the authority to consent on the minor’s behalf to the collection, use, and processing of the minor’s information as described in our Privacy Policy and to the minor’s use of the Service;
- You will use the Service consistent with your parental or guardianship responsibilities and in the best interests of the minor;
- You will inform the minor that their financial activity is being monitored through the Service in a manner appropriate to the minor’s age and developmental capacity.
You agree that you are solely responsible for the legal authority to monitor any minor whose information you provide to the Service, and you agree to indemnify and hold KidsPref harmless from any claim arising from a lack of such authority.
3. The Service
3.1 · Description
The Service connects to one or more bank or financial accounts authorized by the account-holder parent (or, for monitored young adults aged 18–22, by the young adult themselves) and applies a detection algorithm to identify patterns in transaction data that may indicate gambling activity. The Service provides informational signals to the account-holder parent and may provide a view of financial activity and educational features to monitored individuals.
3.2 · No professional advice
The Service provides informational signals only. The Service is not, and does not provide, medical, psychological, psychiatric, addiction counseling, legal, financial, accounting, tax, or other professional advice. Signals provided through the Service are not diagnoses and should not be relied upon as such. Consult appropriate licensed professionals for medical, mental health, legal, financial, or other professional advice.
You acknowledge and agree that:
- The detection algorithm is probabilistic and may produce false positives (signals where no gambling activity has actually occurred) and false negatives (failures to detect actual gambling activity);
- No automated system can detect all forms of gambling activity, particularly activity that does not produce identifiable transaction patterns;
- Decisions about how to respond to signals, including any conversation with a monitored individual, any medical or psychological evaluation, any modification of access to financial accounts, or any other action, are entirely the responsibility of the account-holder parent;
- KidsPref makes no representations or warranties regarding the accuracy or completeness of signals.
3.3 · Educational features
The Service may include educational content and self-guided features designed to support financial and behavioral awareness for monitored individuals. These features provide general information only. They do not constitute, and are not a substitute for, professional counseling, therapy, addiction treatment, or medical advice. KidsPref makes no representations or warranties regarding the effectiveness of educational content for any individual.
3.4 · Third-party services
The Service relies on third-party services, including Plaid for bank connections, Anthropic for AI analysis, and others identified in our Privacy Policy. Use of those third parties’ services is subject to their respective terms and privacy policies. KidsPref is not responsible for the acts or omissions of third-party providers.
3.5 · Changes to the Service
We may modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.
3.6 · Third-party links and the Resources page
The Service, including our Resources page, may link to third-party websites, services, and materials that we do not own or control. We provide these links for convenience and information only; we do not endorse, and we are not responsible for, the content, accuracy, policies, or practices of any third-party site or service. Your use of third-party sites is governed by their own terms and privacy policies, and you access them at your own risk.
4. License grant and restrictions
4.1 · License
Subject to compliance with these Terms, we grant each user a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for personal, non-commercial use consistent with that user’s role.
4.2 · Restrictions
No user may:
- Use the Service for any commercial purpose;
- Use the Service to monitor any individual the account-holder parent does not have legal authority to monitor, including any adult who has not consented, any minor for whom the account-holder is not the parent or legal guardian, or any individual in violation of any custody, divorce, restraining order, or other court order;
- Use the Service to harass, stalk, threaten, or harm any person;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service;
- Use bots, scrapers, or automated tools to access the Service except through APIs we expressly provide;
- Attempt to gain unauthorized access to the Service, its underlying systems, or other users’ accounts;
- Use the Service in violation of any applicable law or regulation;
- Use the Service in any manner that could damage, disable, overburden, or impair the Service;
- Resell, license, sublicense, or otherwise commercialize the Service or any data derived from it.
4.3 · Feedback
If you provide us with feedback, suggestions, or ideas about the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use that feedback for any purpose, including improving the Service, without obligation or compensation to you.
5. Bank account connections
5.1 · Authorization
By connecting a financial account through the Service, the connecting party (either the account-holder parent or the monitored young adult) authorizes KidsPref and Plaid to access transaction data from that account in accordance with our Privacy Policy and Plaid’s terms.
5.2 · Authority
The connecting party represents and warrants that they have full legal authority to authorize the connection of any financial account they connect through the Service.
5.3 · Accuracy of bank data
KidsPref does not control the data provided by Plaid or by financial institutions. We do not represent or warrant that bank data is accurate, complete, or current. Errors in bank data may result in incorrect signals or failure to detect activity.
6. Subscriptions and payment
6.1 · Subscription features
Certain features of the Service may be offered on a subscription basis at the prices and terms displayed at the time of purchase. Subscriptions may be processed through the Apple App Store, in which case Apple’s payment terms apply, or through our payment processor Stripe.
6.2 · Auto-renewal
Unless otherwise stated at the time of purchase, subscriptions automatically renew at the end of each subscription period. Subscriptions may be canceled at any time through the in-app controls or, for App Store subscriptions, through Apple ID account settings.
6.3 · Refunds
Except where required by applicable law or expressly stated by us in writing, all payments are non-refundable. For App Store subscriptions, refunds are handled by Apple in accordance with Apple’s policies.
6.4 · Price changes
We may change subscription prices upon reasonable notice. Price changes take effect at the start of the next subscription period following the notice.
7. User content and conduct
7.1 · User content
Users may provide content through the Service, including feedback, support communications, and information about themselves or others. Users retain ownership of their content. Users grant KidsPref a worldwide, non-exclusive, royalty-free license to use, store, and process the content as necessary to provide and improve the Service.
7.2 · Prohibited conduct
No user may use the Service to:
- Violate any applicable law, regulation, or third party’s rights;
- Submit false, misleading, or fraudulent information;
- Monitor any individual without the legal authority required by Section 2;
- Use the Service in connection with any custody dispute, divorce proceeding, restraining order, or other legal proceeding without disclosing such use to the court or your attorney as required;
- Interfere with the Service’s operation or security.
8. Intellectual property
The Service, including all software, algorithms, design, text, graphics, and other content (excluding user content), is owned by KidsPref or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. Nothing in these Terms grants any user any right to use any of our trademarks, logos, or trade names.
9. Privacy
Use of the Service is also governed by our Privacy Policy, available at detecthebet.com/privacy and incorporated by reference into these Terms.
10. Disclaimers
10.1 · “As Is” provision
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, KidsPref disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10.2 · No professional advice
We do not warrant that the Service will detect all gambling activity, that signals will be accurate, that the Service will be uninterrupted or error-free, or that defects will be corrected. The Service is not a substitute for professional medical, psychological, addiction counseling, legal, financial, or other professional advice.
10.3 · No reliance on educational features
We do not warrant that educational features will produce any particular outcome for any monitored individual. Educational features provide general information only and are not a substitute for professional counseling, therapy, or treatment.
10.4 · Third-party services
We disclaim all liability for the acts, omissions, or failures of third-party services, including Plaid, Anthropic, Apple, or any financial institution.
10.5 · No reliance
You acknowledge that you have not relied on any representation or warranty other than those expressly set forth in these Terms.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
11. Limitation of liability
To the fullest extent permitted by applicable law:
(a) In no event will KidsPref, its officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including damages for loss of profits, goodwill, use, data, or other intangible losses, arising from or relating to the Service, even if KidsPref has been advised of the possibility of such damages.
(b) Without limiting the foregoing, KidsPref will not be liable for damages arising from: (i) any action or inaction taken by any user or any third party in response to a signal or the absence of a signal; (ii) failure of the detection algorithm to identify gambling activity; (iii) any medical, psychological, or addiction outcomes experienced by any monitored individual or other individual; (iv) the acts, omissions, or failures of third-party services; (v) any unauthorized access to any account; or (vi) any loss or alteration of data.
(c) In no event will KidsPref’s total liability for all claims relating to the Service exceed the greater of (i) the amount paid to KidsPref for the Service in the twelve months preceding the event giving rise to the claim, or (ii) one hundred U.S. dollars ($100).
These limitations apply regardless of the legal theory (whether contract, tort, statutory, or otherwise) and even if any remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
12. Indemnification
The account-holder parent agrees to indemnify, defend, and hold harmless KidsPref and its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or relating to:
- (a) Their use of the Service;
- (b) Their breach of these Terms or any representation, warranty, or covenant in these Terms;
- (c) Their violation of any law or any right of any third party;
- (d) Any claim that they lacked legal authority to monitor any minor or other individual whose information they provided to the Service;
- (e) Any decision made or action taken by them in response to signals provided by the Service;
- (f) Any claim by a monitored minor, monitored young adult, or third party arising from their use of the Service to monitor an individual.
A monitored young adult aged 18–22 separately agrees to indemnify KidsPref for the young adult’s own breach of these Terms or violation of applicable law in connection with the young adult’s use of the Service.
We reserve the right, at the indemnifying party’s expense, to assume the exclusive defense and control of any matter for which the party is required to indemnify us, and the party agrees to cooperate with our defense of such claims.
13. Termination
13.1 · Termination by users
The account-holder parent may terminate these Terms at any time by deleting the family account through the Service (Settings → Delete account) or by contacting us at alex@detecthebet.com. A monitored young adult aged 18–22 may terminate their participation by withdrawing consent as described in Section 2.4.
13.2 · Termination by us
We may suspend or terminate any user’s access to the Service at any time, with or without cause, with or without notice. Without limiting the foregoing, we may suspend or terminate access immediately if we believe a user has violated these Terms or applicable law.
13.3 · Effect of termination
Upon termination, the user’s right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including disclaimers, limitations of liability, indemnification, dispute resolution, and miscellaneous provisions.
14. Modifications to terms
We may modify these Terms from time to time. When we make material changes, we will provide notice through the Service, by email, or by other reasonable means before the changes take effect. Continued use of the Service after the effective date of any modification constitutes acceptance of the modified Terms. Any user who does not agree to modified Terms may stop using the Service.
15. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles, except as provided in Section 17 (Arbitration), which is governed by the Federal Arbitration Act.
16. Jurisdiction and venue
For any claim not subject to mandatory arbitration under Section 17, the parties agree to submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York, and waive any objection to such jurisdiction or venue.
17. Binding arbitration and class action waiver
Please read carefully. This section affects your legal rights.
17.1 · Agreement to arbitrate
Except as provided in Section 17.4, the parties agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or the relationship with KidsPref will be resolved exclusively through final and binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, rather than in court.
17.2 · Arbitration procedures
The arbitration will be conducted in New York County, New York, or by video conference at the user’s election. The arbitrator will have exclusive authority to resolve any dispute over the formation, validity, or scope of this arbitration agreement.
17.3 · Class action waiver
The parties agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.
17.4 · Exceptions
This arbitration agreement does not apply to:
- Claims that may be brought in small claims court if they qualify;
- Claims for injunctive relief to protect intellectual property rights;
- Disputes that applicable law expressly prohibits from being resolved by arbitration.
17.5 · Opt out
A user may opt out of this arbitration agreement by sending written notice to alex@detecthebet.com within thirty (30) days after first accepting these Terms. The notice must include the user’s name, the email address associated with the account, and a clear statement of the wish to opt out of arbitration. Opting out does not affect any other provision of these Terms.
17.6 · Severability of arbitration
If the class action waiver in Section 17.3 is found unenforceable, then the entire Section 17 will be null and void, and the dispute will proceed in court under Section 16.
18. Miscellaneous
18.1 · Entire agreement
These Terms and our Privacy Policy constitute the entire agreement between users and KidsPref regarding the Service and supersede all prior agreements.
18.2 · Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
18.3 · No waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision later.
18.4 · Assignment
Users may not assign or transfer their rights or obligations under these Terms without our prior written consent. We may assign these Terms without user consent in connection with a merger, acquisition, sale of assets, or by operation of law.
18.5 · Notices
We may send notices to users through the Service, by email to the email address on the account, or by SMS to the phone number on the account. Users may send notices to us at alex@detecthebet.com.
18.6 · Force majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, war, terrorism, civil unrest, labor disputes, government action, power outages, internet outages, or third-party service failures.
18.7 · Apple end user license agreement
If the Service was accessed through the Apple App Store, the additional terms in the Schedule below apply. To the extent there is any conflict between these Terms and the Apple terms, these Terms govern except where Apple’s terms are required by Apple.
18.8 · Headings
Section headings are for convenience only and do not affect interpretation.
19. SMS and text messaging
If you provide your mobile number and opt in, you consent to receive recurring automated informational and/or marketing text messages from Detect The Bet at that number, including messages sent using an automatic telephone dialing system. Consent is not a condition of any purchase. Message and data rates may apply, and message frequency varies. Reply STOP to unsubscribe at any time, or HELP for help. We may also use SMS as a channel for account or service notices, as described in Section 18.5. Carriers are not liable for delayed or undelivered messages. Your information is handled as described in our Privacy Policy.
Schedule: Apple App Store additional terms
The following additional terms apply if the Service was accessed through the Apple App Store:
- These Terms are between users and KidsPref only, and not with Apple. Apple is not responsible for the Service or its content.
- Apple has no obligation to provide maintenance and support services for the Service.
- If the Service fails to conform to any applicable warranty, the user may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation regarding the Service.
- Apple is not responsible for addressing any claims by users or any third party relating to the Service or possession or use of the Service.
- In the event of any third-party claim that the Service or possession and use of the Service infringes that third party’s intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of any such claim.
- Users represent and warrant that they are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and that they are not listed on any U.S. government list of prohibited or restricted parties.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against users as a third-party beneficiary.
Appendix: Onboarding consent screens
The following in-app screens implement the consent requirements of these Terms. Specific copy and placement may evolve; the consent requirements they reflect will not.

Required checkboxes near the “Create account” button:
- I am at least 18 years old and I am the parent or legal guardian of any minor or young adult I will add to this account, with full legal authority to monitor their financial activity.
- I have read and agree to the Terms of Service and Privacy Policy.
Both must be checked to enable “Continue.”

Detect The Bet is not available for anyone under 13. If you believe this is an error, contact alex@detecthebet.com.
Screen 3 · Monitored minor 13–17 at first sign-in

Parent’s consent is already legally operative. This screen is informational and required for state law compliance.
Screen 4 · Monitored young adult 18–22 at first sign-in

[Parent First Name + Last Initial] has invited you to be monitored through Detect The Bet. Before you continue, please confirm that you consent to this.
By tapping “I consent,” you agree that:
- [Parent First Name + Last Initial] will see your bank transactions and the signals Detect The Bet identifies
- You have read and agree to the Terms of Service and Privacy Policy
- You may withdraw this consent at any time, and your information will be removed from the account
If “I do not consent”: sign out, soft-delete family_members entry, display “Your parent will need to talk with you before you can join this account.” This consent is legally operative for the young adult.
